WEST TERRE HAUTE, Ind. (WTWO/WAWV) — A Terre Haute man and a Kansas woman are facing several felony charges following a traffic stop in West Terre Haute.
According to court documents, Tammy Lynn Grisham, 38, of Kansas, and Darryl Livingston, 37, of Terre Haute, are facing numerous felony charges related to the events of Jan. 19, when police say they had to forcibly remove the two from a vehicle after being pulled over for speeding and broken tail lights.
A West Terre Haute police officer’s narrative states the vehicle they had been driving was clocked going 50 MPH in a 40 MPH zone and lacked working tail lights. A traffic stop took place near the intersection of National Avenue and Schley Place. When speaking with Grisham, who was driving, the officer noted the smell of marijuana coming from the vehicle.
When asked about the odor, Livington, who was in the passenger seat, reportedly told police “It’s mine. I have a medical marijuana license,” and showed officers a cigarillo package. The officer then asked the two to exit the vehicle to allow for a search of the car, and that’s when police say both refused to do so.
“I will hand the little bit of marijuana to you. We are not getting out because I have already told you that’s all we have in the car,” Livingston reportedly told police.
Police said as they were awaiting the arrival of backup units the two rolled up their windows and locked the car’s doors. An officer with a K9 then arrived and reportedly smashed one of the vehicle’s windows and threatened to send the dog inside if the two didn’t exit. At that point, Grisham reportedly opened her door and was removed from the vehicle. Livingston was then removed as well and both were placed under arrest.
A search of the car turned up a large plastic bag containing what was later field tested to be 113 grams of meth in the center console. A loaded Glock 26 9mm handgun with an extended 30-round magazine was located under the driver’s seat.
Police also reported finding two bags in the back seat containing;
- 1.2 grams of cocaine
- 4.8 grams of oxycodone hydrochloride pills
- 4 grams of marijuana
- 102 grams of suspected synthetic marijuana
- Rolls of “plastic sandwich baggies”
- A digital scale
Neither Grisham nor Livingston would admit to possession of the handgun or most of the drugs found in the vehicle. Police said Livingston was found to be on active probation in Vigo County and had a previous conviction for unlawful possession of a firearm by a felon from 2019.
Tammy Lynn Grisham and Darryl C. Livingston have each been charged with;
- Dealing in methamphetamine (more than 10 grams)
- A level 2 felony
- Possession of methamphetamine over 28 grams
- A level 3 felony
- Possession of cocaine
- A level 6 felony
- Dealing in a substance represented to be a controlled substance
- A level 6 felony
- Resisting law enforcement
- A class A misdemeanor
- Possession of a controlled substance
- A Class A misdemeanor
- Possession of marijuana
- A class B misdemeanor
- Possession of a substance represented to be a controlled substance
- A class C misdemeanor
Both were booked into the Vigo County Jail. According to publicly available court records, Grisham was released on electronic monitoring on Jan 25. She has a pre-trial hearing scheduled for May 18.
Livingston remains in custody, held on a $75,000 bond with no 10% allowed. A bond reduction hearing is scheduled for February 17 at 9 a.m.
