DA Alvin Bragg botches case against cop accused of faking evidence in hundreds of convictions

NEW YORK (1010 WINS) — A case against a former NYPD detective accused of fabricating evidence in hundreds of cases was dismissed on Tuesday after a prosecutor for the Manhattan District Attorney’s Office failed to turn over evidence to the defendant’s lawyers.

Joseph Franco was charged with perjury, official misconduct and other offenses in 2019 for allegedly lying about witnessing drug deals that he could not have seen.

Since that accusation, more than 320 convictions that relied on Franco’s testimony have been overturned in New York City.

Stephanie Minogue failed to turn over evidence to the defense, which she was required to do.

Manhattan District Attorney Alvin Bragg immediately removed her from her post as the deputy chief of the Police Accountability Unit, though she currently remains employed at the office, according to the New York Times.

Because the case was dismissed, Bragg’s office won’t be able to press charges against Franco for the same crimes. The case was also sealed as a result of the dismissal, meaning the public won’t have access to details of Franco’s alleged misconduct.

The DA’s Post-Conviction Justice Unit will continue to look for potential wrongful convictions in cases that involved Franco.
