When sheriff's officers arrived, Fulton was still alive with a gunshot wound to his stomach. He told them Berkery had been staying at his mother's home and was causing trouble. So Fulton went there to help. After an argument, Fulton followed Berkery outside, and Berkery turned and shot him, said Assistant District Attorney Roslyn Norman.

Fulton's mother, Crystal Fulton, told the judge that her son was someone who always put other first, and he went out of his way to help Berkery.

Defense attorney Rachel Dolly asked the judge to set bond for Berkery who has no felony criminal history and served several years in the Army before becoming disabled. He is capable of financial independence because of veteran benefits and his training as a chef, Dolly said.

Judge Jesse Stone set a $50,000 bond with electronic monitoring and pretrial supervision required.
