CLARKSBURG, W.Va. (WV News) — An Enterprise man is charged with felony third-offense driving on a license revoked for diving under the influence following a traffic stop on Tuesday.
Jason Earl Higginbotham, 37, allegedly switched places with his girlfriend after law enforcement executed a stop in an attempt to make it appear as if he had not been operating the vehicle, according to the criminal complaint against him.
Higginbotham’s criminal history shows he has been charged and convicted “numerous times” for driving on a license that was revoked for DUI, Harrison Sheriff’s Deputy K. Moneypenny alleges.
While he was being processed after arrest, Higginbotham asked if he was being charged with driving on a revoked license for DUI. When he was informed that was indeed the charge, Higginbotham admitted he was the one driving and said he “cannot go back to jail a year-and-a-half because it was felony,” Moneypenny alleges.
According to previous reporting from the WV News, Moneypenny was the arresting officer when Higginbotham was charged with felony third-offense driving revoked for DUI in 2018.
During that arrest, Moneypenny recovered a “syringe with liquid in it, along with a bag with a white, crystal-like substance, both identified as meth by the defendant,” according to the complaint.
In August 2018 Higginbotham was sentenced to 1-3 years in prison and fined $6,000.
In other court news:
— A Morgantown man is facing a felony charge for allegedly failing to make child support payments for nearly two years.
Larry Scott Napper, 32, is charged with repeatedly and willfully failing to pay his court-ordered support, according to criminal complaint against him.
Napper has not made a payment since Dec. 24, 2019 and owes the mother of his child $15,246.19, Clarksburg Patrolman A. Moore alleges.
As of Thursday, Napper was incarcerated at North Central Regional Jail. His bail is set at $5,000 cash or surety.
— A homeless man is charged with grand larceny after allegedly stealing a vehicle from outside of Clarksburg residence.
Aaron Lynn Frye, 27, is alleged to have stolen a 2006 Buick Rainer valued at $5,500, Clarksburg Patrolman M. Blankenship alleges.
Blankenship responded to a report of a stolen vehicle on Sept. 6, according to the criminal complaint against Frye, and made contact with the victim.
The victim reported she had seen Frye outside of her home prior to going to sleep, but had left her home unlocked in order to let company from out of town get into her home, Blankenship alleges.
When the victim woke up, her car keys were missing from inside her home and her vehicle was gone. The vehicle was later located in Doddridge County in Frye’s possession, according to the complaint.
As of Thursday, Frye was incarcerated at North Central Regional Jail.
