Seventy-four-year-old Board of Regents member Jack Stark is accused of interfering with a sexual assault case against women's bodybuilding coach Douglas Anders.
The complaint filed against Stark said he sent a text to former Huskers football player Willie Miller to "not show up" as a witness in the sexual assault case on Aug. 14, 2020.
It was a week later that Miller was subpoenaed to show up in court on Aug. 20, 2020.
Stark's legal counsel asked the judge to dismiss the case since Miller hadn't yet been subpoenaed when Stark communicated with him.
But state prosecutors said Stark was aware Miller would be called as a witness.
"We're optimistic that the truth is going to come out in this case and dr. Jack stark will continue to advocate for the least of our brothers and sisters," said Michael Coyle, defense attorney.
In what the judge described as an unusual move, the judge said he wouldn't make a decision today and will instead take the evidence under advisement.
The courts will revisit the case after both sides submit their briefs by November.
