Families of Dayton shooting victims sue high-capacity ammo magazine manufacturer

The man who pulled the trigger is dead, unable to be held accountable for shooting and killing nine people in Dayton’s Oregon District. But families of the shooting victims said someone needs to be held accountable, which is why they are suing the company the manufactures high-capacity magazines like the one Connor Betts was using on August 4, 2019.

“There's never a day where I don't feel the pain,” said Dion Greene, who was with his father that night. Derrick Fudge was one of Betts’ victims.

He and LaSandra James, who lost her daughter Lois Oglesby in the violence, appeared with their attorneys Monday. James said she’s raising Oglesby’s two daughters now, and the girls have questions.

“She’ll never get to know her mother and how beautiful she was, neither one of them,” James said. “And it's sad.”

The lawsuit is targeting the company Kyung Chang, a South Korean firm with US headquarters in Nevada. They made the 100-round magazine that Betts used, allowing him to fire 41 shots in just 30 seconds, killing nine people.

“No one needs a 100 round capacity magazine,” said Ben Cooper, of the Columbus law firm Cooper and Elliot. “ It is only useful by the military, or in mass shootings.”

The attorneys claim it’s the first lawsuit of its kind.

They said the company provides no safeguards to prevent its product from being used in a mass shooting. They are seeking damages for the families and are asking a judge for an injunction preventing the company from selling its product.
