BALTIMORE (WBFF) - Nick and Marilyn Mosby building a war chest? The political power couple living under the weight of a federal probe into their finances and their attorney A. Scott Bolden confirming to FOX45 news this week the couple had created a legal defense fund last month.

How much they've collected he wouldn’t say but called it necessary, “when you are being wrongly harassed by the federal government.”

"Any little thing they can come after her for they will," said Warren Brown.

Brown is a high profile Baltimore criminal defense attorney who this week posted on social media in support of Mosby saying " like her or not, as a black person, you should contribute to her defense funds."

Brown told FOX45 News that long ago he foresaw troubles for the couple because he says the words "black" and "power," together, in some circles cause consternation.

Public figures aside, Brown believes they have every right to solicit funds for a strong defense.

"You don’t bring a knife to a gun fight the U.S. government has unlimited resources to bring to bear in their prosecution of her, this is going to cost them in the high six figures, maybe even a million dollars." Says Warren brown, Baltimore criminal defense attorney.

Other experts FOX45 News spoke with disagree, saying not only does it signal the couple may be expecting an indictment but also raises significant legal and ethical concerns, laws governing defense funds make it difficult to know who is donating and how much.

“This is highly problematic and there are massive potential conflicts of interest that chief prosecutor needs a legal defense fund,” said David Williams President of the Taxpayers Protection Alliance.

"There is nothing good about this. That’s why, no matter what happens and how the money is raised, there are going to be questions swirling around Marilyn Mosby for months and possibly years to come,” Williams said.

Brown says as long the couple isn't promising any favors in exchange for donations he sees no conflict.

"It just depends on whether or not there was a quid pro quo and there’s nothing to suggest there was quid pro quo, those who contribute will be contributing because they’re interested in her being well representing, having solid defense and having a chance," said Brown.
