Miami man charged with lewd and lascivious battery on child in Snapchat meetup with teen

INDIAN RIVER COUNTY — Deputies arrested a 33-year-old Miami man accused of sexually assaulting a girl he drove to meet after months of Snapchat talks, officials said in a report.

Carlos Lagos, 33, was charged with two counts of lewd and lascivious battery on a child during his arrest in Fellsmere, according to Indian River County Sheriff’s Office records.

The girl is 13;  he claimed to be 17, deputies said.

An arrest affidavit shows deputies were called early Saturday to look into allegations of sexual battery made against Lagos.

They were told he drove to meet a 13-year-old and took her to McDonald’s and then to a convenience store parking lot, where law enforcement officials said the sexual battery occurred.

Family members called 911 after getting text messages from the girl saying she was scared, and that she had left in the night to meet Lagos, according to the affidavit.

The report stated she was sending the messages from in the car with Lagos who was driving her home, and that her family passed the information along to law enforcement.

According to the report, he dropped her off at a street near her home, and deputies found him shortly afterward.

She told deputies Lagos knew her age through Snapchat where he told her he was 17, and asked to meet her.

She said he sent pictures and that she had blocked him, but he made new accounts and continued to communicate with her “back and forth for several months.”

Deputy Michael Dilks said in an affidavit the girl did not know Lagos’ name.

Dilks said in the report he questioned Lagos when he was located after dropping the girl off near her home and leaving in his black 2013 Honda car.

He said Lagos told him he thought she was 18, and “denied having any sexual contact” with the girl but only met with her and ate at McDonald’s.

Sheriff's Office records show Lagos was placed in Indian River County Jail on $200,000 bail and released on bond April 12.

He appeared in court Monday and was ordered to return for an arraignment May 21, according to court records.
