Montgomery father charged with capital murder in baby's death

A 20-year-old Montgomery man is facing a capital murder charge after his 5-month-old baby died at a Birmingham hospital. 

Montgomery police Lt. Jarrett Williams said officers responded to a local hospital about 11:30 a.m. April 7 on a report of the infant, Austin Diaz Flora, suffering life-threatening injuries. Flora was taken to Birmingham for treatment but ultimately succumbed to his injuries Saturday, Williams said. 

Ricardo Ocana, 20, was charged with capital murder April 13, 2021 after his 5-month-old died days earlier.

Williams did not specify what kind of injuries the child had. 

After a forensic exam, a medical examiner ruled the baby's death a homicide and Ricardo Ocana, the child's father, was arrested Tuesday.

Ocana was booked into the Montgomery County Detention Facility without bond, Williams said. . 

Williams said the circumstances surrounding the child's death remain under investigation.
